With the recent weather events that have swept through Aotearoa, many throughout the country will be grappling with making claims to their insurer and all that this entails. How can ADR practitioners assist in this process?  

Join Emily Flaszynski, a Member of the Canterbury Earthquake Insurance Tribunal (CEIT) and Partner at Mortlock McCormack, who will share her first-hand insights into this very timely topic. 

By diving into lessons learnt (the good, the bad, and the ugly) from the past, this webinar will ensure ADR practitioners are well-equipped to assist those who have now been affected by the 2023 floods and cyclones.  

Emily will explore:  

  • How the CEIT works, its processes and the techniques that have been used to cut through emotionally charged and highly complex claims 

  • the benefits of using facilitation, mediation and arbitration (decision making) as part of the inquisitorial process, providing access to justice 

  • how and why New Zealand needs to establish a standing body that deals with unresolved insurance claims for all natural disasters.  

  • Understanding standard proof, who this lies with and what pitfalls should be avoided
