The number of disputes relating to Environmental, Social and Governance (ESG) matters is growing internationally and here in New Zealand. These disputes can take many forms, from claims brought by investors, to contractual disputes, to judicial review claims against governments. While some of these disputes are designed to compensate one party for an infringement of rights by the other, others are brought with broader strategic aims in mind. Regardless of the motive, ESG litigation is resource-intensive and may take years to reach a substantive hearing. This gives rise to the question: what role can we, as lawyers or dispute resolution professionals, play in supporting parties to resolve claims effectively and efficiently where broader ESG aims may be at play? In this session, Hannah Bain (Special Counsel, Litigation and Head of Climate Change at Russell McVeagh) will explore recent trends in ESG-related litigation in New Zealand and overseas, and the role that ADR may play in this rapidly evolving area.

About Hannah
Hannah leads Russell McVeagh’s climate change practice and advises clients on a wide range of issues relating to the transition to a low-emissions, climate-resilient future, including mandatory climate-related disclosures, greenwashing risk, the emissions trading scheme and climate-related disputes. Hannah has recently led the firm’s advice on the new mandatory climate-related disclosures regime and advised the Climate Change Commission in connection with its review of the 2050 emissions reduction targets under the Climate Change Response Act 2002. In addition, Hannah has over 10 years' experience as a commercial litigator, with particular experience in complex commercial disputes in the infrastructure, energy, banking and financial services sectors, and with regulatory investigations.
Hannah is a member of the New Zealand Law Society's Climate Change Law Reform Subcommittee.
